On October 5, 2021, the Office of the U.S. Trade Representative announced its decision to consider the possible reinstatement of previously extended product exclusions.

As background information, in the course of Section 301 investigation, the U.S. Trade Representative imposed additional duties on products of China in four tranches. For each tranche, USTR established an exclusion process. The first tranche of exclusions expired in December 2019 and the final tranche of exclusions expired in October 2020.

Starting in November 2019, USTR established processes for submitting public comments on whether to extend particular exclusions. Pursuant to these processes, the U.S. Trade Representative subsequently extended 549 exclusions (137 exclusions covered under List 1, 59 exclusions on List 2, 266 exclusions on List 3, and 87 exclusions on List 4A). All of these 549 extended exclusions have expired in early 2021.

USTR is now requesting comments on whether to reinstate these previously extended product exclusions, which means the comment opportunity only covers these 549 exclusions that were previously granted and extended. An index of 549 previously extended exclusions can be found here.
